Short answer: AI for bankruptcy attorneys covers eleven recurring tasks in a consumer practice, from the first call to the second-course certificate. Petition software (Best Case, NextChapter, Glade) handles the forms, the creditor matrix and CM/ECF filing. An AI receptionist takes the first call, extraction tools turn statements into numbers, and chat assistants draft client letters. The slowest step is often the document packet: 60 days of payment advices, bank statements, tax returns and the counseling certificate, with a 45-day dismissal rule behind it. You can hand off the work. Not the responsibility.
"AI" means three different things to a bankruptcy attorney. Chat assistants that draft. Tools that read statements and turn them into numbers. And software that moves the case forward: reminders, notices, filing. This guide takes a Chapter 7 or Chapter 13 file in the order it moves through your office and names, for each task, the tools that handle it and what they cost. Every rule and third-party price below links to its source. It's not legal advice: the rules are quoted, not applied to your cases.

Not every row is AI in the strict sense. Rows 1, 5, 10 and parts of 4 and 11 use models that read or write. The rest is plain automation.
Before filing: intake, means test, credit counseling
The first three tasks settle whether there is a case at all. None of them needs a chat assistant.
1. First call and intake
NACBA's own AI webinar lists "expedite client intake" first among the things AI can do for a bankruptcy practice.13 An AI receptionist such as Smith.ai answers calls 24/7, qualifies the lead and books the consult, so a caller who rings after a garnishment notice doesn't hit voicemail.1
2. Means test and current monthly income
Current monthly income is the average of the debtor's income over the six months ending the month before filing (11 U.S.C. §101(10A)).14 The figures it's compared against move. The U.S. Trustee Program's latest IRS data apply to cases filed on or after July 15, 2026, and its latest Census median income figures to cases filed on or after April 1, 2026.15 Stretto says Best Case keeps IRS and Census data current.2 NextChapter lists a "quick means test tool" in its Pro Plus plan.3 Either calculation is only as good as six months of pay stubs, and collecting those is task 4.
3. Credit counseling certificate
An individual debtor must receive credit counseling from an approved agency within 180 days before filing.16 DebtorCC lets attorneys track both courses and download certificates, at $19.95 per household per course on its own site.4 Through the NextChapter integration you send the invite from the case and the certificate populates into it. The price listed there is $14.95 per household for the first course and $9.95 for the second.5 Same provider, different price by channel.
The document packet: where consumer cases stall
The document packet is where a clean intake turns into a stalled file. Software can compute the means test in seconds. It can't make a client find six months of pay stubs, three accounts' statements and last year's return. That part is chasing, and the rules put a clock on it.
| What the rules say | Deadline | Source |
|---|---|---|
| Credit counseling | Within 180 days before filing | U.S. Courts, Chapter 7 basics16 |
| Payment advices | Received within 60 days before filing | 11 U.S.C. §521(a)(1)(B)(iv)17 |
| Current monthly income | Six months before the filing month | 11 U.S.C. §101(10A)14 |
| Schedules and statements | With the petition or within 14 days | Fed. R. Bankr. P. 1007(c)18 |
| Photo ID, SSN proof, income, account statements | At least 14 days before the 341 meeting, or as the trustee asks | U.S. Trustee Program19 |
| Tax return to the trustee | At least 7 days before the 341 meeting | §521(e)(2)(A); Rule 4002(b)(3)1720 |
| §521(a)(1) information missing | Case dismissed on the 46th day | 11 U.S.C. §521(i)17 |
Local rules and trustees add requirements; check yours. One Chapter 13 trustee in Cleveland may also ask for the spouse's pay stubs and return, a vehicle title and proof of insurance.21 Another, near Columbus, asks business debtors for 12 months of business bank statements and two years of returns.22
4. Collecting the document packet
If your firm already runs NextChapter or Best Case Cloud, start there. NextChapter's questionnaire imports straight into the case, which DokuTrak does not do. NextChapter's MyChapter collects answers and uploads that the attorney reviews before import, and NextMessage sends text reminders; both are included from the Pro Plus plan at $129 per user per month.3 Best Case Cloud has a client portal with an integrated questionnaire and document sharing.6 Glade reads, renames and extracts pay stubs and bank statements, and lets staff send an illegible page back with a note.23
DokuTrak does one narrower job: it takes the chase off your desk, whatever petition software you use. You send one itemized request link. Clients upload without creating an account. Follow-ups go out on a schedule and read as a file status ("4 of 9 documents received"), not a nag. At upload, AI flags a file that looks wrong or unreadable, like a statement for the wrong month or a cropped pay stub. The attorney or paralegal accepts every file. DokuTrak doesn't know bankruptcy law: it never judges whether a document satisfies §521 or your trustee, and it doesn't fill forms. Plans are Solo $79, Team $199 and Agency $449 a month, with a 14-day trial.
Which one? If the packet already comes in through your petition software and nobody chases, keep it. DokuTrak fits the firm where a paralegal still spends the week asking, or where collection starts before the case exists in the software.
What the chase costs is your own arithmetic. For example: if you file 8 cases a month, each packet has about 12 items, and half of them need three follow-ups at five minutes each, that's 6 × 3 × 5 = 90 minutes per case, or 12 hours a month spent asking. Put in your own numbers. For wording that gets documents back, see these document request email samples, and for the broader problem, how to stop chasing clients for documents.
From statements to schedules
Once the pages arrive, someone turns them into numbers. Rule 1007(b)(1) requires schedules of assets and liabilities, current income and expenditures, and a statement of financial affairs.18 Those figures come from the statements and stubs in the packet.
5. Turning statements and stubs into numbers
A debtor with several accounts means a thick stack of statements. CounselPro extracts and categorizes bank statement transactions and exports them to Excel, at $499 per matter or from $100 a month.7 DocuClipper converts bank statements to Excel, CSV or QBO, from $20 a month billed annually ($29 billed monthly) for 60 pages.8 Glade extracts key fields at upload (task 4).
6. Petition, schedules, SOFA and the creditor matrix
Rule 1007 requires the schedules and statements with the petition or within 14 days, and a list with the name and address of each entity on Schedules D, E/F, G and H.18 Best Case imports credit reports from the three bureaus into the case; Stretto says attorneys "save 60 minutes of data entry per case" this way.2 NextChapter pulls and imports tri-merge credit reports.24 Glade builds every form from one case record and catches duplicate entries.23
Filing and getting paid
7. E-filing and the filing fee
Filing a Chapter 7 case costs $338: a $245 filing fee,16 plus a $78 administrative fee and a $15 trustee surcharge (fee schedule items 8 and 9).25 Best Case OneTouch navigates the court site and uploads the filing.2 NextChapter includes ECF integration in every plan,3 and Glade files through CM/ECF across districts.23 The attorney still signs, and still answers for what is filed.
8. Getting the attorney fee paid
When a client pays the fee in installments, collecting it is admin work. LawPay costs $19 a month, with Visa, Mastercard and Discover payments at 2.99% + $0.30, eCheck at 1%, scheduled payments and IOLTA compliance.9 Fee financing is a separate question from automation: the U.S. Trustee Program wrote in 2022 that bifurcated fee models using outside financing "invite significant scrutiny."26
The trustee and the 341 meeting
9. Documents to the trustee
The tax return goes to the trustee at least 7 days before the meeting of creditors.1720 The U.S. Trustee Program also asks for photo ID, proof of Social Security number, current income and account statements at least 14 days before, and notes that almost all 341 meetings are held virtually on Zoom.19 Best Case submits documents directly to Chapter 7 trustees and orders tax transcripts.2 Glade calendars 341 meetings from court notices.23 Whatever the trustee needs has to be collected first, which is task 4 again.
10. Client prep and plain-language updates
Clients are anxious and rarely technical. A 341 prep sheet or a "what happens next" letter is a call you don't take. ChatGPT Business ($20 per user per month billed annually, $25 monthly) and Claude Pro ($20 a month) can draft these. OpenAI says it won't train on a Business workspace's data by default.1011 Check the data terms of the exact plan you use. NextChapter's NextMessage sends clients text reminders (Pro Plus).3
The ethics rule here is specific. ABA Formal Opinion 512 (July 29, 2024) says a client's informed consent is required before a lawyer inputs information relating to the representation into a self-learning generative AI tool, and that boilerplate consent in an engagement letter is not sufficient.27
After filing: notices and the second course
11. Court notices and post-filing deadlines
In a Chapter 7 case, the financial management course certificate is due within 60 days after the first date set for the meeting of creditors, unless the course provider has already notified the court.18 DebtorCC lets attorneys register and track second-course certificate filing.4 Notices A.I. saves PACER notices straight to the case file and adds hearings to the firm calendar, for $200 a year standalone.12 Glade reads PACER notices and turns them into the next action.23
How to choose AI for bankruptcy attorneys
Start from the software you already run, not from the word AI.
- Solo on NextChapter or Best Case: use what you pay for first (means test, questionnaire, e-filing, notices). Add a chat assistant for letters, under the checks below.
- Paralegal still chasing packets: the gap is collection, not forms. That's where a request-and-follow-up tool such as DokuTrak fits, next to your petition software. The document collection software guide explains the category.
- Firm reconsidering its petition software: compare Best Case, NextChapter and Glade on the tasks above, not on the AI label.
Before any client file goes into an AI tool, four checks based on ABA Formal Opinion 512:27
- Know what the tool does with client data, and how long it keeps it.
- Find out whether the tool learns from your inputs, and turn that off if you can.
- Get the client's informed consent, not a boilerplate line.
- Have a human review every output before it reaches a filing.
The same logic runs through DokuTrak: AI flags, the attorney or paralegal accepts. For how that first-pass flag works, read AI document validation for client files. For an intake list to start from, the law firm intake checklist is a base, and DokuTrak for law firms shows the request flow.

Frequently asked questions
Is there a ChatGPT for bankruptcy lawyers?
Not one tool. General assistants such as ChatGPT Business and Claude draft letters, summaries and client updates. Bankruptcy petition software such as Best Case, NextChapter and Glade handles the forms and CM/ECF filing. ABA Formal Opinion 512 (July 29, 2024) says a client's informed consent is required before the lawyer inputs information relating to the representation into a self-learning generative AI tool.
Can AI do the means test?
Petition software calculates it from the data you enter. Best Case and NextChapter both include a means test tool, and Stretto says Best Case keeps the IRS and Census figures up to date. The inputs still come from the client's income records for the six months before filing, because current monthly income is a six-month average under 11 U.S.C. §101(10A). The attorney reviews the result.
Is it safe to upload client bank statements to an AI tool?
It depends on the tool's data terms. Check whether the tool learns from your inputs, how long it keeps files, and whether the client has given informed consent, as ABA Formal Opinion 512 describes. As one example, OpenAI says it won't train on a ChatGPT Business workspace's data by default. Read the terms of the exact plan you use.
What documents does a bankruptcy attorney need from the client?
The statutory core under 11 U.S.C. §521 includes payment advices received within 60 days before filing, the most recent federal tax return for the trustee, and the credit counseling certificate. The U.S. Trustee Program also lists photo ID, proof of Social Security number and account statements for the 341 meeting. Your district and your trustee may ask for more.
Can AI file the petition for me?
Petition software such as Best Case, NextChapter and Glade files through CM/ECF, so software can handle the upload itself. The attorney still signs the petition and remains responsible for everything that is filed.
