What is a Georgia Domestic Relations Financial Affidavit?

Uniform Superior Court Rule 24.2 is the court rule that sets both the duty to exchange financial information in Georgia domestic cases and the form itself (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). The rule says the affidavit is under oath and in substantially the form it prints (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

The affidavit has five numbered parts. Part 1 names the spouses, the dates of marriage and separation and the children; part 2 summarizes income and needs; part 3 covers gross and net monthly income; part 4 lists assets; part 5 lists expenses and payments to creditors (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Income is broad on this form. The list runs from wages and tips through rental income, severance, trust income, capital gains, gifts, prize winnings and fringe benefits that significantly reduce living expenses, while means-tested public assistance such as TANF or food stamps is left out (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Who sends it, and when

Every party in a covered case completes and serves one, with or without a lawyer; the Office of Child Support Services is exempt (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). The affiant signs before a notary public, as the signature block on the form shows (Georgia Division of Child Support Services, Domestic Relations Financial Affidavit (fillable form)). Superior court clerks and county websites post the form, and some add local instructions of their own (Douglas County, Georgia, Domestic Relations Financial Affidavit instructions).

Where to get a Georgia Domestic Relations Financial Affidavit

  1. Read the current Rule 24.2 and its form in the Uniform Superior Court Rules published by the Supreme Court of Georgia.
  2. Ask the superior court clerk in your county whether it uses its own packet or a standing order with different dates.
  3. Collect the two most recent wage statements and the papers for each asset and debt before filling in figures.
  4. Fill in monthly amounts, complete the child support worksheet if children are involved, and sign before a notary.
  5. Serve the other party, then file a Certificate of Service with the clerk (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Wrong files people send instead

  • Writing full Social Security, tax ID or account numbers, or a child’s full birth date, on the form (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).
  • Typing weekly pay without converting it with the rule’s monthly factor.
  • Claiming an asset as separate without stating the basis, such as a gift or an inheritance.
  • Forgetting the child support worksheet and schedules that must be served with the affidavit in a support case.
  • Serving an amended affidavit too close to the final hearing.

The Rule 24.2 timeline

The rule counts back from each hearing or session. The table lists the dates as Rule 24.2 states them; a local standing order may set different ones, so read any order entered in your case.

Hearing or trial dayBring the original affidavit, worksheets and schedules for the court (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition))

Part 3: income, and what to attach

All income is entered as a monthly average, whatever the date it was received (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). You can complete part 3A or attach Child Support Schedule A instead (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

The form tells you what to staple on. Salaried and hourly workers attach copies of the two most recent wage statements, and anyone with self-employment or rental income attaches a sheet itemizing the calculation (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Part 3B shows net income. On this form, net monthly income is income from employment after deducting only state and federal taxes and FICA (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). It also asks for your pay period and the number of exemptions you claim.

Rule 24.2A fixes the math. Weekly amounts are converted at 4.35 weeks per month, and hourly pay for a 40-hour week is multiplied by 174 hours (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Part 4: assets and separate property claims

Each asset gets a value, and columns let each spouse show the portion claimed as separate. In this part, separate property is the non-marital share of an asset, and you must state the amount and the basis, such as pre-marital ownership, a gift, an inheritance or the source of funds (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

  • Cash, stocks and bonds, CDs and money market accounts, and each bank account listed separately.
  • Retirement accounts: pensions, 401(k) plans, IRAs and profit sharing (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).
  • Money owed to you and any tax refund due.
  • The home and other real estate, each with the debt owed on it.
  • Vehicles with their loans, the net cash value of life insurance, furniture, jewelry and collectibles.

Part 5: monthly expenses and creditors

Part 5A groups average monthly expenses under household, automobile, other vehicles, children’s expenses, the affiant’s other expenses and other insurance (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). Health, dental and vision premiums each show the children’s portion on a separate line (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Part 5B lists payments to creditors: who is owed, the balance, the monthly payment and whose debt it is. Part 5C adds everything into total monthly expenses. Credit card and loan statements, and the latest mortgage statement, give you each of those numbers in one place.

Redaction, exceptions and what happens if it is missing

Only the last four digits of Social Security numbers, tax identification numbers and account numbers may appear, and children are listed by year of birth, never by full birth date (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). On request and for good cause, the court can seal the affidavits and worksheets (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Cases filed with a complete separation agreement or consent order, resolving everything but the divorce itself, do not need the affidavit unless the court orders one (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). If child support is involved, the child support worksheet and schedules still go with the proposed final judgment, and the agreement must state both parties’ gross and adjusted incomes (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). A party who fails to furnish it may face contempt, a continuance of the hearing or other sanctions at the court’s discretion (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Check older copies before you rely on them. The fillable form on the state child support website prints a different exchange schedule, for example with the answer or thirty days after service of the complaint (Georgia Division of Child Support Services, Domestic Relations Financial Affidavit (fillable form)). Douglas County’s packet asks for the affidavit when the divorce complaint is filed (Douglas County, Georgia, Domestic Relations Financial Affidavit instructions).

Questions people ask

Is a financial affidavit required in every Georgia divorce?

It is required when child support, alimony, property division, a change to support or alimony, or attorney’s fees are at issue (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)). It can be skipped when the case is filed with a complete settlement or consent order, unless the court orders one. A support case still attaches the child support worksheet to the proposed final judgment (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

Does the Georgia financial affidavit have to be notarized?

Yes. Rule 24.2 says the affidavit is under oath (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)), and the form closes with a signature line for a notary public (Georgia Division of Child Support Services, Domestic Relations Financial Affidavit (fillable form)).

Do I need the child support worksheet too?

In cases involving child support, yes. The worksheet and schedules from the Georgia Child Support Commission are completed and served together with the affidavit (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).

What personal information should I leave off?

Show only the last four digits of Social Security, tax ID and account numbers, and give each child’s year of birth rather than the full date (Georgia Uniform Superior Court Rules 24.2 and 24.2A (April 2026 edition)).
