Illinois Financial Affidavit (Family & Divorce Cases): forms, add-ons and papers to attach

By Arthur Teboul, DokuTrak · Published

In brief

The Illinois financial affidavit is the statewide Financial Affidavit (Family & Divorce Cases) that every Illinois circuit court must accept (Illinois Courts, Statewide Forms: Financial Affidavit). You list monthly income, expenses, assets and debts, attach pay stubs, tax returns and bank statements, and send it to the other party.

What is an Illinois financial affidavit?

The Financial Affidavit (Family & Divorce Cases) is the form the Illinois Supreme Court requires in all circuit courts for sharing finances in a family case (Illinois Financial Affidavit (Family & Divorce Cases), ATJ 251.5). State law calls for one form statewide, so Cook County and a downstate county use the same document (Illinois Marriage and Dissolution of Marriage Act, 750 ILCS 5/501).

The main form runs through basic information, your jobs and business, last year’s taxes, monthly gross income, payroll deductions, maintenance and child support, monthly living expenses, debts, assets, lawsuits and claims, and tax refunds owed. When a section runs out of room, you complete the matching add-on form and attach it (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).

Part 1 of the form has you tick which documents you attached, and the form says you must attach them if you have or can get them (Illinois Financial Affidavit (Family & Divorce Cases), ATJ 251.5). Supporting documents are what turn the affidavit from a list of claims into evidence.

Who sends it, and when

You fill in your own affidavit, whether or not you have a lawyer; the Illinois Supreme Court’s Commission on Access to Justice publishes the forms (Illinois Courts, Statewide Forms: Financial Affidavit). Illinois Legal Aid Online offers a free guided interview, called an Easy Form, that asks questions and completes the forms from your answers (Illinois Courts, Statewide Forms: Financial Affidavit). A family law firm or paralegal usually collects the attachments and checks them against the figures.

Where to get an Illinois financial affidavit

  1. Open the Financial Affidavit page in the statewide forms section of illinoiscourts.gov.
  2. Download and save each PDF to your computer before you type anything, or you will lose your work (Illinois Courts, Statewide Forms: Financial Affidavit).
  3. Read “How to Complete a Financial Affidavit” first; it explains the monthly math and the due dates.
  4. Fill in the main form, then any add-on form for a section that needs more room.
  5. Flatten the finished PDF before e-filing, then send it with the attachments to the other party.

The main form and the eleven add-on forms

The statewide set has twelve forms plus the instructions, each dated 06/2025 on the courts page (Illinois Courts, Statewide Forms: Financial Affidavit). You always fill in the main affidavit. By contrast, an add-on form is an extra page for one section, used only when that section needs more room. The table pairs each form with the documents that usually back it.

Who must fill it in, and when it is due

The instructions name two triggers. You must complete one when temporary support, temporary maintenance or interim attorney fees are requested, or when a local court rule or the judge requires it (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).

There is no single statewide deadline. The affidavit is due by any deadline set by local rule or by the judge, and it is due at the same time as a request for temporary child support, maintenance or interim fees (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3). Ask the circuit clerk which local rules apply in your county.

What to attach, and what to hide first

The form lists four kinds of attachments: pay stubs or other proof of income, income tax returns with K-1, W-2 and 1099 forms and all schedules, bank statements, and other papers that verify your debts and assets (Illinois Financial Affidavit (Family & Divorce Cases), ATJ 251.5). State law says the affidavit shall be supported by documentary evidence such as tax returns, pay stubs and banking statements (Illinois Marriage and Dissolution of Marriage Act, 750 ILCS 5/501).

Before you attach anything, hide sensitive numbers in full. The instructions ask you to black out Social Security or taxpayer numbers, driver’s license numbers, financial account numbers and card numbers (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3). Unlike some states, Illinois does not leave the last four digits showing. The affidavit itself should not contain them either (Illinois Financial Affidavit (Family & Divorce Cases), ATJ 251.5).

  • Pay: the most recent pay stubs from each job; see the pay stub guide for what a complete one shows.
  • Taxes: last year’s federal return as filed, with every schedule and the W-2 and 1099 forms.
  • Banks: the most recent bank statement for each account named in the cash section.
  • Values: an appraisal, a recent sale of a similar item, or a pricing site for a home or a car, since the instructions accept those to show fair market value (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).

How the Illinois form turns pay into monthly amounts

Every income and expense line is monthly. The instructions give a worked case: $600 a week times 52, divided by 12, is $2,600 a month (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).

  1. Weekly pay: multiply by 52, then divide by 12 (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).
  2. Every two weeks: multiply by 26, then divide by 12 (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).
  3. Twice a month: multiply by 24, then divide by 12 (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).
  4. Quarterly: multiply by 4, then divide by 12 (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).
  5. Bills paid once or twice a year: add up the yearly total, then divide by 12 (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).

Saving, flattening, sending and filing

Flattening means saving the filled PDF so it can no longer be changed, which the courts page requires before you e-file (Illinois Courts, Statewide Forms: Financial Affidavit). In Adobe Acrobat or Reader, choose Print and pick “Adobe PDF” or “Print to PDF”; other software usually has a “Save as PDF” option (Illinois Courts, Statewide Forms: Financial Affidavit).

Sending and filing are separate steps. You must send the affidavit and supporting documents to the other party, or to their lawyer, and complete a Proof of Delivery form (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3). You file the affidavit and attachments with the circuit clerk only when a local rule or court order requires it (How to Complete a Financial Affidavit (Family & Divorce Cases), ATJ 250.3).

The form has no notary block. Under 735 ILCS 5/1-109, your signature certifies that the contents are true and that a false statement is perjury (Illinois Financial Affidavit (Family & Divorce Cases), ATJ 251.5).

  • Reminders go out on a schedule, by default 2, 5, 10 and 14 days after the request, until the file arrives.
  • With AI review switched on in your workspace (it is off by default), each upload gets a first pass that flags a file that is not the requested document or an unreadable or blurry scan. It says so when it is not sure.
